Mercia Gas Terms and Conditions

1. SCOPE OF SERVICE CONTRACT
Mercia Gas will provide the level of cover as set out below in respect of the private domestic gas central heating system or any other domestic gas appliances specified.

DEFINITIONS
  1.1 The Whole Central Heating System The central heating boiler or warm air unit and the gas supply from the appliance isolating cock together with the pump, thermostatic radiator valves, motorised valves and cylinder thermostat, time, temperature and pressure controls, radiators, pipework, hot water cylinder, feed and expansion tank. or in the case of warm air, ductwork and heat emitters together with an integral circulator providing domestic hot water.
  1.2 Domestic Hot Water The water heater and the gas supply from the appliance isolating cock together with the time and temperature control.
  1.3 Other Approved Gas Appliances Specified: All operational parts on any other gas appliances specified.

LEVELS OF COVER
  1.4 Priority Attention: Mercia Gas will endeavour subject to workload and labour availability to call the same day in response to any breakdown or failure of the central heating or other essential gas appliance.
  1.5 Safe Check: At the same time as the annual service visit, a Service Engineer will check the safe operation of the gas appliances serviced.
  1.6 Annual Visit: A Service Engineer will service the appliances specified once a year and clean and adjust them as necessary. The Service Contract includes a visual inspection of the whole central heating system and any visible fault found will be remedied.
  1.7 Breakdown Free Labour and Parts: No charge will be made in respect of labour or parts and materials used in repairing any reported fault (see exclusions).

2. PERIOD OF SERVICE
  2.1 Where payment is annually in advance the service contract is valid for one year from the date on which the Service Contract is first made and for each year it is renewed, unless prior arrangements have been made.

3. PAYMENT AND RENEWAL
  3.1 Payment for the Service Contract is made annually in advance, unless prior arrangements have been made.
   3.2 The renewal date of the Service Contract will be the yearly anniversary of the date the Service Contract was first taken out. Notification of the renewal charge will be sent in advance of the renewal date.
   3.3 This Service Contract remains valid as long as the payment is continued at least 75'7. of full contract price must be paid prior to terminations by customer.
   3.4 Mercia Gas at its discretion may refuse to offer renewal of any Service Contract.

4. CHANGE OF OWNERSHIP
   4.1 If the ownership of the premises in which central heating or the appliance(s) covered by this Service Contract changes, the new owner shall have the benefit of the Service Contract for the remainder of the period for which the payment has been made.
   4.2 No refund will be made for the unexpired part of any service Contract.

5. PROVISION OF SPARE PARTS
  5.1 Mercia Gas may supply and fit adequate replacement parts or components which are not the same as the parts being replaced.
  5.2 Mercia Gas shall not be held responsible for any delay in the provision of spare parts by suppliers.

6. REPLACEMENT OF CENTRAL HEATING APPLIANCE OR OTHER GAS APPLIANCES
  6.1 This Service Contract does not include the replacement of the central heating appliance or other gas appliance(s) in the event of spare parts or components not being reasonably available.

7. CONDITION OF CENTRAL HEATING SYSTEM OR OTHER GAS APPLIANCE
  7.1 Acceptance of a central heating system or any other gas appliances or system components onto a Service Contract does not imply that it is installed satisfactorily or to the prevailing standards of Mercia Gas. Mercia Gas does not accept responsibility for any inadequacy attributable to the original design and makes no warranty as to fitness for purpose or condition.

8. USE OF SUB-CONTRACTORS
  8.1 Mercia Gas reserves the right to use sub-contractors to carry out all or any part of the services to be provided under this Service Contract.

9. LIMITATION OF OBLIGATIONS
  9.1 Mercia Gas shall not be liable if it is unable to carry out its obligations under the Service Contract due to Severe weather Conditions industrial disputes or force majeure.

10. EXCLUSIONS
The following are excluded from the Service Contract:
  10.1 The replacement of decorative parts, i.e. cooker burner caps, oven linings and pan supports.
  10.2 Repairing the appliance's casing, decorative parts, paintwork. enamel or other damage which does not affect the way the system works.
  10.3 The electrical power circuit which the installation is connected to.
  10.4 Any part of the system (including pipes, ducts, and wiring) which are too difficult to get to safely or which are impossible or impractical to maintain because of where they are.
  10.5 All energy-management systems and equipment associated with them.
  10.6 Unvented hot-water cylinders and their controls
  10.7 Any domestic water supply from the hot water cylinder or gas appliance to and including taps.
  10.8 The cold water supply, its feed and outlets.
  10.9 Any defect or inadequacy attributable to the original design of the gas central heating system. / appliances.
  10.10 The fabric of the building or pipework and flue pipework buried in it.
  10.11 Any defect caused through malicious or wilful action, negligence, misuse, or third party interference.
  10.12 Any defect or damage occasioned by fire, lightening, explosion, flood, storm, tempest, frost, impact or other extraneous cause.
  10.13 Consequential damage or loss arising as a result of a defect occurring in the central heating appliance system or the gas appliances unless such a defect is attributable to the negligence of Mercia Gas.
  10.14 Any defect or damage occurring from the failure of the public electricity or water supply.
  10.15 Descaling and any work arising from hard water scale deposits or from damage caused by aggressive water.
  10.16 Condition of water in central heating system, causing circulation problems, i.e. sludge.
  10.17 Any work that is connected with adding a corrosion inhibitor to the central-heating system.
  10.18 The performance of a gas appliance as a result of the condition of the natural gas supplied to the property, to include foreign bodies, chemical reactions etc.
  10.19 Gas leaks on domestic appliances limited to £5.00 materials and 1 hours labour.
  10.20 The cost of adding inhibitor, if system needs to be drained.
